Nesquik "How Do You Shake It" Voter Sweepstakes Rules

To enter: Access Youtube.com/contest/Nesquik between 12:01 am ET 9/24/07 and 11:59pm ET 10/13/07 and log into your Youtube account and follow the on-screen instructions to vote for your favorite video submission and opt in to enter the sweepstakes (“Entry”). All entrants must have a valid Youtube account. Limit one (1) entry per person and per e-mail address, regardless if more than one person uses the same e-mail address. In case of dispute as to identity of the winner who enters, Entry will be declared/made by the registered user (meeting eligibility criteria) of the YouTube account, and if a prize is won, it will be awarded to that registered user. Entries generated by a script, macro or other automated means will be disqualified.

Prizes: Five (5) Grand Prize winners will each receive an iPod® (ARV $250). Fifty (50) First Prize winners will each a NESTLÉ® NESQUIK® Ready-to-Drink Goodie bag. (ARV $50 each). No cash substitutions for prizes will be permitted and prizes are non-refundable and non-transferable except at sole discretion of sponsor. Nestlé reserves the right to substitute prize of equal or greater value. Federal, state and local taxes are the sole responsibility of the winner. Total ARV for all prizes is $3,750. Prize won by a minor, if eligible, will be awarded in the name of the parent or legal guardian.

Winner Selection: Winners will be selected in a random drawing from all eligible entries on or about 10/15/07. Odds of winning depend on number of eligible entries received. Winners will be notified via their Youtube account on behalf of Nestle on or about 10/15/07. By entering the Sweepstakes, entrants accept and agree to these rules and the decision of the judges, which shall be final. Winners may be required to sign a Winner’s Agreement and Release and return it by the date specified in notification, or prize will be forfeited, in its entirety, and another winner may be selected. Return of any prize or notification as undeliverable will result in disqualification and an alternate winner may be selected. By submitting an entry, a winner agrees to allow use of his or her name, likeness and/or biographical information for promotional purposes (including posting on this Web site), except where prohibited.

Eligibility: Sweepstakes is open to legal residents of the 50 United States and District of Columbia, 18 years or older, except employees and the families of Nestlé USA, YouTube, Marcus Thomas LLC, Archway and their affiliates, subsidiaries, promotions and advertising agencies. Nestlé USA, YouTube, Marcus Thomas LLC, Archway and their affiliated companies, representatives, agents or employees are not responsible for, and shall be indemnified by the prize winner against, any claims, injuries, losses or damages of any kind resulting from acceptance, use, misuse, possession, or loss of the prize. Sponsor reserves the right, in its sole discretion, to cancel or suspend this Sweepstakes, in its entirety or in part, should a virus, bug, tampering, unauthorized intervention, fraud, technical failures, or other causes beyond Sponsor’s control corrupt the administration, security, fairness, integrity or proper play of the Sweepstakes. Sponsor is not responsible for incorrect or inaccurate entry information, whether caused by Internet users or by any of the equipment or programming associated with or utilized in the Sweepstakes by a technical or human errors which may occur in the processing of the entries in the sweepstakes. Sponsor reserves the right to withdraw the transmission of this sweepstakes at any time and award the Prize from among eligible entries received prior to the date of the withdrawal.
